Booking Terms and Conditions
In
order to avoid disputes and to keep things clear there are conditions, which are
given below.
These Booking Conditions spell out our obligations to you and your commitments
to us, when you book your accommodation with us as it forms the basis of our
contract with you.
COMMUNICATIONS
BETWEEN US
Where we refer in these Booking Conditions to your contacting us for any purpose
(regardless of the words used to describe the contact - for example 'notify us',
'advise us', 'give us', etc) this means you must contact us via e-mail using the
e-mail address sandclub@fsmail.net or by writing to 20 Headingley
Road, Norton, Doncaster, DN6 9EN. If you experience any problems in doing
so, please telephone us on 01302 700905. We may also contact you by post if we
cannot, for whatever reason, contact you by e-mail. References in these Booking
Conditions to "send" include e-mail and post, as appropriate.
OUR COMMITMENT TO YOU
1. YOUR RESERVATION
Once you have booked and paid your deposit or full payment as applicable, we
will reserve your rental on the basis of these terms and conditions. Your
booking will be taken as confirmed and a binding contract between us will come
into existence when we send our Confirmation & Account to you. Prior to
doing so, we may send you an acknowledgement of your booking. Any such
acknowledgement simply confirms that we are dealing with your booking and is not
a confirmation of it. In these Booking Conditions, 'you' and 'your' means all
persons (or any of them) named on the booking (including anyone who is added or
substituted at a later stage). Please
check your Confirmation & Account together with all other documents we send
you as soon as you receive them. Contact us immediately if any information that
appears on the Confirmation & Account or any other document appears to be
incorrect or incomplete as it may not be possible to make changes later. We can
only accept a booking if the lead name is a minimum of 18 years on or before the
date of the rental period or from single sex groups
(excluding single sex couples) where any single member of the party is not under the age of 25.
The agreement with you is only to provide accommodation – we are not
responsible for your travel arrangements or any other arrangements regarding
your holiday.
2. ACCOMMODATION AND FACILITIES
The
facilities available either on the site or in the vicinity are not under our
control i.e. Swimming Pool and may not be available due to maintenance.
If we become aware of any unavailability on the site, we will endeavour
to inform you as soon as we become aware. Some
the facilities in the apartment may not be available from time to time due to
circumstances beyond our control – such as a guest breaking the television.
We will however endeavour to rectify the problem via our local property
management service as soon as we are aware of the problem.
3. PRICE
The
price confirmed you will be the final price and will not change. We reserve
however the right to correct errors at any time prior to the price being
confirmed at the time of booking.
4. IF WE CANCEL YOUR RENTAL ARRANGEMENTS
We
may have to cancel your rental arrangements, which we reserve the right to do.
However, we promise we will not cancel your rental unless you have failed to
comply with any requirement of these Booking Conditions entitling us to cancel
(such as paying on time) or where we are forced to do so as a result of unusual
and unforeseeable circumstances beyond our control, the consequences of which we
could not have avoided even with all due care. No compensation will be payable
where we cancel in such circumstances and we will have no liability beyond
offering the choices set out below (not available where you fail to comply with
any requirement of these Booking Conditions entitling us to cancel).
If we have to cancel, we will tell you as soon as possible. (Except where you
have failed to comply with any requirement of these booking conditions entitling
us to cancel.) We will offer you the choice of:

Taking
the alternative accommodation we offer you.
We have extensive contacts on the Island and should be able to offer
you suitable alternative self-catering accommodation.

or
if you decide not to take the alternative we offer you, receive a prompt
refund of all monies paid to us.
If
you wish to take the alternative accommodation, you must tell us within the time
mentioned in our offer or, if none is mentioned, within seven days of our offer
or we are entitled to assume that you require a refund.
5.
ASSUMPTION OF LIABILITY
a)
Except where otherwise expressly stated, we regret we cannot accept liability or
pay any compensation where the performance or prompt performance of our
contractual obligations is prevented or affected by 'force majeure'. In these
Booking Conditions, 'force majeure' means any event which we could not, even
with all due care, foresee or avoid. Such events may include war or threat of
war, riot, civil strife, terrorist activity, industrial dispute, natural or
nuclear disaster, adverse weather conditions, fire and all similar events
outside our control.
b)
Please note, we cannot accept any liability for any damage, loss, expense or
other sum(s) of any description (1) which on the basis of the information given
to us by you concerning your booking prior to our accepting it, we could not
have foreseen you would suffer or incur if we breached our contract with you or
(2) which did not result from any breach of contract or other fault by
ourselves. Additionally we cannot accept liability for any business losses.
6. RETURN OF SECURITY DEPOSIT
Where
a security deposit is required it will be returned to
the lead name when we have received the apartment key back and our local
management have confirmed to us that there are no lost items or damage to the
apartment. It is in your interest
to return the key by registered post. The
lead name on the booking form will be liable for any damage costs in excess of
the security deposit. It is in your
interest to inform us immediately of any damage that occurs.
YOUR COMMITMENT TO US
7.
DEPOSITS
The
lead name must pay a deposit of £50 (£100 for Xmas, New Year & Easter)
plus a refundable £50 security deposit (if required) at the time of booking. If
booking is within 56 days of your departure, the lead name must pay the full
cost of the rental plus any security deposit when booking. Your payment and the
sending to you of a confirmation creates a contract between us. Our booking
conditions form the basis of your contract with us. You should read and ensure
you understand these (raising any queries you may have with us) before asking us
to confirm your booking. By asking us to confirm your booking, you are liable to
be regarded as having had the opportunity to have read and understood our
booking conditions, and to have actually done so before a contract between us
came into existence. If you are booking a late/special offer, any extra
information and conditions that apply to the late/special offer holiday will
also be part of your contract. If in doubt you should check with us.

8.
PAYING FOR THE BALANCE OF YOUR HOLIDAY
Our Confirmation & Account will show the total price you must pay for your
holiday. You must pay the balance 56 days before the beginning of the rental
period or within seven days of the invoice date, whichever is later. If you book
within 56 days before the beginning of the rental period, you must pay the full
cost of your rental plus the £50 security deposit. If for any reason the
balance is not received by us on time, we will be entitled to treat your booking
as cancelled by you and keep your deposit.
9. IF YOU
CHANGE YOUR BOOKING
DATES
Should you wish to
change your booking dates in any way we will do our best to meet your wishes.
Any change you wish make within 56 days of the beginning of the rental period
will be treated as a cancellation and we will make a cancellation charge as set
out below. We will send you a new Confirmation & Account.
10. IF YOU CANCEL YOUR BOOKING
If you wish to cancel all or part of your booking, the lead name on the booking
should write to us. Upon receipt of your cancellation the
following scale of refunds apply: - 55 – 30 days before the start of the
rental period – 50% less the booking deposit, 29 - 25 days – 25% - less the
booking deposit, 25 days or less - no refund. In all cases the security deposit
will be refunded.
11. YOUR HOLIDAY INSURANCE
Adequate personal travel insurance is essential for your own protection. We may
require the lead name to provide us with your insurance details. It is your
responsibility to ensure that the insurance cover you purchase is adequate for
the particular needs of you and your party. Please read your policy details
carefully and take them with you on holiday. We do not check insurance policies.
12. YOUR RESPONSIBILITIES
a) You are be responsible for the behaviour of yourself and your party.
The lead name is liable for any costs we incur as a result of their
behaviour or negligence.
b)
You and your party are required to vacate the apartment by 10am on your final
day unless we have agreed otherwise. We
may be able to agree this if there is no one arriving that day or if it is a
departure day other than Tuesday or Friday.
c)
The people named on the Confirmation
& Account can only use the apartment. You are not
allowed to let anyone else share the apartment or stay there.
Please let us know in writing or email before the commencement of the
rental of any changes to your party.
